Our Partner Djordje Novcic and Senior Associate Janez Voncina have analyzed how Liability for damages, resulting from the collision of vessels and regulated by Act on Merchant Shipping, provides numerous specifics in comparison to the regulatory framework by the Act on Obligations, that are yet to be clarified by court practice and legal doctrine.

The specifics are not insignificant, in spite of the fact that establishing obligation to compensate damage is dependant on fulfillment of all of the required conditions of delict respectively non-contractual liability (existence of the injuring and injured party, damage, inadmissible action, committed by the injuring party, the causal relation between such an action and the damage, as well as guilt of the injuring party).
